Nexby is designed to deliver personalized travel experiences. We ask users to log in so we can:

• Show relevant places based on region, interests, and preferences
• Ensure that all feedback and reviews are from verified users
• Store booking and preference history securely
• Enable password recovery using email or connected login account

We never collect unnecessary personal data or share your details with advertisers.

1. Acceptance of Terms

By accessing or using the Nexby mobile application ("App") and website ("Platform"), you ("User", "You", "Your") agree to be bound by these Terms of Use, our Privacy Policy, and our Refund & Cancellation Policy. If you do not agree, please discontinue use immediately.

2. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding agreement under Indian law. If using the platform on behalf of a company or entity, you must have the authority to bind that organization.

3. Account Creation and Deletion

You agree to provide true, accurate, and updated information when creating your Nexby account.

• You are solely responsible for safeguarding your login credentials.
• You are responsible for all activities conducted through your account.
• You may request deletion of your account at any time by contacting Nexby Support.

4. Services Overview

• Nexby facilitates the discovery, planning, and booking of travel-related services including experiences, stays, events, and local activities.
• All listings are based on information received from third-party providers and may change without notice.
• Nexby acts solely as a facilitator and is not a party to any agreement between users and service providers.
• Payments are collected on behalf of Service Providers and remitted after applicable deductions.
• Nexby may provide links or redirections to third-party platforms for certain services. Nexby does not control or take responsibility for such third-party services, including their availability, pricing, quality, or transactions. Any interaction or transaction with third-party platforms is solely between the user and the respective provider.

5. Payments, Refunds, and Cancellations

• All payments are processed securely via authorized third-party payment gateways.
• Refunds and cancellations are governed by Nexby’s Refund & Cancellation Policy.
• Some services may be non-refundable or carry cancellation fees.
• Nexby is not liable for delays or disruptions caused by Force Majeure events (natural disasters, pandemics, strikes, etc.). Refunds in such cases will be subject to the respective service provider’s policies.
• GST and applicable taxes may be added where relevant and invoiced separately.
• Nexby is not responsible for payment failures, delays, or issues arising from third-party payment gateways or banking systems.

6. User Obligations

You agree to:

• Use the platform lawfully and responsibly
• Maintain the integrity and confidentiality of your account
• Not misrepresent your identity or provide false information
• Not misuse the platform, engage in scraping, reverse engineering, or violate intellectual property
• Not interfere with or disrupt Nexby’s services, networks, or data systems

7. Service Provider Listings

• All Service Providers are independent and solely responsible for the services they offer.
• Nexby does not control or guarantee service quality, availability, or legal compliance.
• Nexby does not verify all listings and is not liable for any false, outdated, or misleading information.
• Users enter service agreements with Providers at their own discretion and risk.
• Service Providers are solely responsible for fulfilling bookings, providing services, and handling any service-related issues or disputes with users.

8. Intellectual Property Rights

• All logos, trademarks, graphics, software, and content on Nexby’s platform are the property of Nexby or its licensors.
• You may not reproduce, modify, distribute, or reverse-engineer any part of the platform without written consent.
• Unauthorized use may result in legal action.

9. User-Generated Content

Users may submit content such as images, reviews, or suggestions on the Nexby platform. By submitting such content, you grant Nexby a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and modify such content for platform operations and marketing purposes.

You represent that you own or have the necessary rights to share such content and that it does not violate any third-party rights.

Nexby reserves the right to remove or moderate any user-submitted content at its sole discretion.

10. Disclaimers

• Nexby provides its services “as is” and without warranties of any kind.
• Nexby does not guarantee the accuracy, completeness, or reliability of listings provided by service providers.
• We do not guarantee the accuracy, availability, or uninterrupted operation of the platform.
• We are not responsible for errors, user conduct, or third-party failures.
• Nexby may suspend or disable user or provider accounts suspected of fraud, abuse, or policy violations, and may report such activity to authorities.

11. Limitation of Liability

• Nexby shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the platform.
• Our maximum liability, if any, shall not exceed the total amount paid by the user to Nexby in the past 6 months.

12. Termination

• Nexby may suspend or terminate your access for violating these Terms.
• We are not liable for any resulting loss of data, bookings, or payments after termination.

13. Dispute Resolution

• Users agree to attempt informal resolution of disputes via Nexby Support first.
• If unresolved, all disputes will be subject to the exclusive jurisdiction of courts in Gautam Buddha Nagar, Uttar Pradesh, India.

14. Governing Law

These Terms of Use shall be governed by and interpreted in accordance with the laws of India.

15. Changes to Terms

We may update these Terms at any time. Updated versions will be posted on the platform and effective immediately. Continued use of Nexby constitutes acceptance of the revised Terms.
